Welcome to Green Behr Pest Control & Termites ("Green Behr," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of greenbehr.com (the "Website") and the pest control, termite, rodent, and wildlife services we provide (the "Services"). By using the Website or scheduling Services with us, you agree to these Terms. If you do not agree, please do not use the Website or our Services.

1. Use of Our Website

You may use the Website for lawful purposes, such as learning about our Services, requesting an inspection or estimate, and contacting us. You agree not to:

• Use the Website in any way that violates any law or regulation
• Submit false, misleading, or someone else's information through our forms
• Send spam or attempt to gain unauthorized access to the Website, its servers, or any connected systems
• Interfere with the operation or security of the Website, including by introducing viruses or malicious code
• Copy, scrape, or reuse Website content for commercial purposes without our written permission

2. Website Information

Content on the Website, including information about pests, treatments, and prevention tips, is provided for general informational purposes only. It is not a substitute for an on-site inspection by a licensed pest control professional. Every property is different, and we cannot diagnose or recommend treatment for a specific property without inspecting it.

We work to keep the Website accurate and up to date, but we do not guarantee that all content is complete or current. Prices, promotions, service areas, and service offerings may change without notice.

3. Estimates & Service Agreements

Quotes given by phone, email, chat, or through the Website are estimates based on the information you provide. Final pricing may change after an inspection if the size of the property, level of infestation, type of pest, or conditions on site are different than described.

Some Services, including termite treatments, termite bait stations, and recurring pest control plans, are covered by a separate written service agreement, contract, or graph. If anything in that agreement conflicts with these Terms, the written service agreement controls for that Service.

4. Scheduling & Property Access

• We will do our best to arrive within the scheduled time window, but arrival times may vary due to weather, traffic, or prior appointments. Weather may require us to reschedule exterior treatments.
• You agree to give our technicians safe and reasonable access to the areas to be inspected or treated, including gates, garages, attics, and interior rooms as needed.
• Please secure aggressive pets and let us know about any locked gates, access codes, or hazards before your appointment.
• You confirm that you own the property or have the owner's permission to authorize Services. For rental and vacation properties, the person scheduling Service is responsible for coordinating with tenants or guests.
• If we cannot access the property at the scheduled time, or if you cancel with less than 24 hours' notice, a trip or rescheduling fee may apply.

5. Treatment Preparation & Safety

Green Behr uses products registered for their intended use and applies them according to label directions and Florida law. For the safety of your household and the success of the treatment, you agree to:

• Follow any preparation and after-care instructions we give you before and after treatment
• Tell us in advance about anyone in the home who is pregnant, has allergies, asthma, chemical sensitivities, or other health concerns, and about pets, fish tanks, gardens, or wells on the property
• Keep people and pets away from treated areas until they are dry or for the time period we advise
• Not disturb bait stations, traps, monitoring devices, or exclusion work we install

Pest problems can be made worse by moisture, landscaping, clutter, food sources, and structural openings. We may recommend changes to help control pests; the results of the Services may depend on whether those recommendations are followed.

6. Payment Terms

• Payment is due when Services are completed unless your written service agreement says otherwise.
• We accept the payment methods listed on your invoice. If you enroll in automatic payments, you authorize us and our payment provider to charge your saved payment method for recurring Services until you cancel.
• Past-due balances may be subject to late fees as permitted by law, and we may pause recurring Services and guarantee coverage until the account is brought current.
• You are responsible for reasonable collection costs, including attorney's fees, if an unpaid balance is sent to collections, to the extent permitted by law.

7. Recurring Service & Cancellation

We offer monthly, every-45-day, and quarterly service plans. Recurring Service continues on the agreed schedule until either you or we cancel. Unless your service agreement states a different notice period or minimum term, you may cancel recurring Service at any time by calling or emailing us before your next scheduled visit. Services already performed are not refundable. We may decline or discontinue Service at our discretion, for example if a property is unsafe to service.

8. Results & Guarantees

Pest control reduces and manages pest activity, but no company can promise that a property will be permanently free of all pests. Any guarantee, re-service policy, or termite warranty applies only as described in your written service agreement or invoice, and only while your account is active and current. Unless stated in writing, re-treatments between scheduled visits for covered pests are provided at our discretion.

EXCEPT AS EXPRESSLY STATED IN A WRITTEN SERVICE AGREEMENT, THE WEBSITE AND SERVICES ARE PROVIDED "AS IS," AND GREEN BEHR DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of Liability

To the fullest extent permitted by law, Green Behr and its owners, employees, and technicians will not be liable for any indirect, incidental, special, or consequential damages, including lost rental income, arising from your use of the Website or the Services. Green Behr is not responsible for damage caused by pests before or after treatment, damage from hidden or inaccessible areas, or pre-existing conditions of the property.

To the fullest extent permitted by law, our total liability for any claim related to the Website or Services is limited to the amount you paid Green Behr for the specific Service giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under Florida law.

10. Indemnification

You agree to defend and hold harmless Green Behr and its owners, employees, and technicians from claims, losses, and expenses (including reasonable attorney's fees) arising from your misuse of the Website, your violation of these Terms, or your failure to follow safety and preparation instructions, except to the extent caused by our negligence.

11. Intellectual Property

The Website and its content, including text, photos, graphics, logos, and the Green Behr name and bear logo, belong to Green Behr or its licensors and are protected by copyright and trademark laws. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.

12. Third-Party Links

The Website may link to third-party websites and services, such as social media, maps, review sites, and booking or payment tools. We do not control and are not responsible for those sites, and their own terms and privacy policies apply. Your use of personal information on the Website is also covered by our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute related to these Terms, the Website, or the Services will be resolved in the state or federal courts located in Osceola County, Florida, and you agree to the jurisdiction of those courts. If any part of these Terms is found unenforceable, the rest will remain in effect.

14. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a new effective date. Your continued use of the Website or Services after changes are posted means you accept the updated Terms.
